10. Tóm tắt các kết quả mới của luận án: 

Thứ nhất, luận án rút ra những đặc điểm tương đồng và khác biệt cơ bản về cấu trúc tổ chức và chức năng hoạt động giữa hai thể chế chính trị. Thể chế chính trị CHXCHCN Việt Nam và CH Pháp có điểm giống nhau cùng thể hiện tư tưởng nhà nước pháp quyền trong tổ chức thể chế chính trị. Hai nhà nước thuộc hai châu lục Á-Âu đã cùng vận dụng, kế thừa, đổi mới và hoàn thiện mô hình cấu trúc tổ chức thể chế chính trị nhà nước pháp quyền. Mặc dù cùng là nhà nước pháp quyền nhưng Việt Nam và Pháp có mô hình cấu trúc tổ chức nhà nước khác nhau. Cộng hòa thứ Năm của Pháp là nhà nước pháp quyền theo mô hình thể chế cộng hòa bán tổng thống với cấu trúc hệ thống đa đảng chính trị và mô hình thể chế nhà nước theo hình tam giác đều, quyền lực nhà nước được tổ chức, phân chia theo học thuyết tam quyền phân lập. Khác với CH Pháp, thể chế chính trị của Việt Nam là Nhà nước Pháp quyền theo mô hình Cộng hòa Xã hội chủ nghĩa, quyền lực thuộc về Nhân dân, Đảng Cộng sản Việt Nam là lực lượng lãnh đạo Nhà nước và xã hội.

Thứ hai, luận án phân tích về chức năng hoạt động của thể chế chính trị CHXHCN Việt Nam và của CH Pháp cho thấy cả hai cùng có điểm giống nhau là đều có các thể chế nhà nước thực hiện chức năng lập pháp, hành pháp và tư pháp nhưng nội dung và tính chất thực hiện các chức năng trong quá trình hoạch định chính sách công là khác nhau.

Thứ ba, qua so sánh những đặc điểm tĩnh và động về sự giống và khác nhau giữa thể chế chính trị CHXHCN Việt Nam và CH Pháp, luận án nêu ra những điểm thành công và hạn chế nhất định của mỗi thể chế.

Thứ tư, luận án chứng minh phương pháp nghiên cứu so sánh theo quan điểm cấu trúc chức năng đã vận dụng so sánh hiệu quả hai thể chế chính trị khác nhau để tìm ra những điểm tương đồng, khác biệt, những thành công và hạn chế của mỗi thể chế chính trị và phương hướng hoàn thiện. Kết quả nghiên cứu của luận án cũng góp phần củng cố thêm cho cách tiếp cận cấu trúc chức năng khi tiến hành nghiên cứu, đó là các cấu trúc giống nhau nhưng được tổ chức khác nhau ở mỗi thể chế chính trị và ngược lại.

Thể chế chính trị của CHXHCN Việt Nam và CH Pháp khác nhau là do cấu trúc tổ chức và chức năng hoạt động của Việt Nam theo nguyên tắc tập trung quyền lực, của CH Pháp là tam quyền phân lập. Nhưng cả hai cùng có điểm chung là đều vận dụng tư tưởng nhà nước pháp quyền cho cấu trúc tổ chức thể chế. Do vậy, luận án tập trung nêu một điểm kiến nghị khả thi, phù hợp về cấu trúc tổ chức đó là trong thời gian sắp tới, Đảng và Nhà nước có thể vận dụng thành lập cơ quan bảo hiến: Hội đồng Hiến pháp theo đặc điểm riêng của thể chế chính trị Việt Nam.

Sử dụng cho hoạt động giảng dạy và nghiên cứu chuyên ngành chính trị học, quốc tế học, khu vực học trong Trường Đại học Khoa học Xã hội và Nhân văn, Đại học Quốc gia Hà Nội.

10. Summary of the new findings of the thesis: 

Firstly, the thesis points out crucial similarities and differences of the two political systems’ organisation structures and operation functions. Tthe Vietnamese socialist republic and its counterpart have a similarity as their political systems are based on the idea of the state rule of law. The two countries in Asia-European continents both have been applying, innovating and improving their organisational structures of political systems in accordance with the rule of law. Although Vietnam and France are states ruled by law, they have different organisational structures. The Fifth French Republic is semi-presidentialism with muliti-political party system.  Its state model is a equal triangular with the state power organised and divided through the principle of power seperation. Conversely, The Vietnamese political institutions are a socialist state ruled by law which its power is belong to the People and the Vietnamese Communist Party is the force leading the State and society.         

Secondly, the thesis examines their operation functions to clarify they have similarities that there are state institutions implementing functions of legislation, administration and jurisdiction. However, contents and characteristics of those implementation in the process of policy making are different.   

Thirdly, through comparing action and inaction traits of similarities and differences between political institutions of the Vietnamese socialist republic and of the French republic, the thesis underlines both significant achievements and limitations of each political system.   

Finally, the thesis illustrates comparative research method with a structural function approach in applying successfully to a comparison of the two different political regimes in order to point out similarities and differences, outcomes and problems, and susgestions. The conclusion of the thesis also strengthen structural function approach in conducting research that same structures are organised differently within every political institutions and vice versa.

The Vietnamese political system differs the French political regime due to organisational structures and operational functions of Vietnam based on the principle of power centralism, and of its counterpart followed by the principle of three power seperation. However, they both a similarity that they have applied the rule of law’s thought to organisational structures of their political systems. As a result, the thesis gives a fruitful and reasonable recomendation on organisational structure that particularly, in the coming future the Party and State could consider to found a constitutional agency such as Constitutional Council with her own characteristics of political regime.
